Cash Card Terms and Conditions
Article 1. Use of Card and Cardless ATM
- (1) A holder of an ordinary deposit account (such holder is called "Customer," and such account is called "Bank Account") with PayPay Bank Corporation ("Bank") shall be entitled to use a Cash Card ("Card") issued for the Bank Account and services for providing a function of a Cash Card through the Bank or the Partner’s application (“Application”) on a smartphone (such services are called "Cardless ATM" , and collectively with a Cash Card, "Card and Cardless ATM") in any of the following cases (except that the case under C) shall not apply to the Cardless ATM):
- A) when making a deposit at an automated deposit machine (including an automated teller machine, "Deposit Machine") of any financial institution or other entity having a business alliance with the Bank for cash deposit services ("Deposit Partner") through the joint use of an online automated deposit machine;
- B) when withdrawing funds at an automated withdrawal machine (including an automated teller machine, "Withdrawal Machine") of any financial institution or other entity having a business alliance with the Bank for cash withdrawal services ("Withdrawal Partner") through the joint use of an online automated withdrawal machine;
- C) when requesting a funds transfer using funds automatically withdrawn from the Bank Account and transferred to the recipient' s account at an automated funds transfer machine (including an automated teller machine that allows funds transfers, "Funds Transfer Machine") of any financial institution or other entity having a business alliance with the Bank for funds transfer services ("Card Funds Transfer Partner") through the joint use of an online automated transfer machine; and
- D) when conducting other transactions specified by the Bank.
- (2) The Card and Cardless ATM can be used only during the hours specified by the Bank as well as the Deposit Partner, the Withdrawal Partner and the Card Funds Transfer Partner (the Card Funds Transfer Partner does not support the Cardless ATM transactions).
Article 2. Ownership of Cards; No Assignment or Other Transfer of Cards
- (1) The ownership of the Cards shall belong to the Bank. The Bank shall provide the Customer with a Card.
- (2) The Customer is not allowed to assign, lend, provide as security or otherwise grant any third party right in a Card or smartphone in which the Cardless ATM is installed ("Device") to others or allow any third party to use it without the Bank' s approval.
Article 3. Deposit of Funds at Deposit Machine
- (1) To deposit funds at a Deposit Machine, the Customer must insert a Card in the Deposit Machine by following the instructions on the display of the Deposit Machine or use the Cardless ATM by following the instructions on the display of the Deposit Machine as well as the Application and operate the Deposit Machine by loading cash in the Deposit Machine.
- (2) The Customer can make a deposit at a Deposit Machine only in the types of bills and coins specified by the Deposit Partner for each type of the Deposit Machines. The deposit limit per transaction shall be an amount not to exceed the amount of the maximum number of bills and coins specified by the Deposit Partner.
- (3) When the Customer needs account statements indicating a deposit amount after making a deposit with a Card pursuant to Article 3.(1), the Customer should use the Bank' s Account Statement Delivery Service to receive monthly account statements by post each month. In order to use the Account Statement Delivery Service, the Customer must pay the fee separately specified by the Bank.
Article 4. Withdrawal of Funds at Withdrawal Machine
- (1) To withdraw funds at a Withdrawal Machine, the Customer must insert a Card in the Withdrawal Machine by following the instructions on the display of the Withdrawal Machine or use the Cardless ATM by following the instructions on the display of the Withdrawal Machine as well as the Application and enter the Customer' s Personal Identification Number (PIN) as well as an amount of funds for withdrawal accurately.
- (2) The Customer can withdraw funds at a Withdrawal Machine in increments specified by the Deposit Partner for each type of the Withdrawal Machines. The withdrawal limit per transaction shall be an amount not to exceed the amount specified by the Withdrawal Partner. The daily maximum limit of the total amount of cash withdrawals and withdrawals for funds transfers shall be the amount specified by the Bank.
- (3) When funds are withdrawn at a Withdrawal Machine, if the total amount of funds for withdrawal and the Withdrawal Fee under Article 7 exceeds the withdrawal limit, the Customer cannot make such withdrawal.
Article 5. Funds Transfer at Funds Transfer Machine
- (1) To request a funds transfer using funds automatically withdrawn from the Customer' s Bank Account and transferred to the recipient' s account at a Funds Transfer Machine, the Customer must insert a Card in the Funds Transfer Machine by following the instructions on the display of the Funds Transfer Machine and enter the Customer' s PIN and other prescribed information accurately.
- (2) The Customer can make a funds transfer at a Funds Transfer Machine in increments specified by the Card Funds Transfer Partner for each type of the Funds Transfer Machines. The funds transfer limit per transaction shall be an amount not to exceed the amount specified by the Card Funds Transfer Partner. The daily maximum limit of the total amount of funds transfers and cash withdrawals shall be the amount specified by the Bank.
- (3) When requesting a funds transfer at a Funds Transfer Machine, if the total amount of funds for transfer, the Withdrawal Fee under Article 7 and the funds transfer fee under Article 8 exceeds the withdrawal limit, the Customer cannot make such funds transfer.
Article 6. Deposit Fee
When the Customer makes a deposit at a Deposit Machine, the fee for the use of the Deposit Machine ("Deposit Fee") specified by the Bank shall be automatically withdrawn from the Customer' s Bank Account to which such deposit is made at the time of deposit.
Article 7. Withdrawal Fee
When the Customer withdraws funds at a Withdrawal Machine or a Funds Transfer Machine, the fee for the use of the Withdrawal Machine or the Funds Transfer Machine ("Withdrawal Fee") specified by the Bank shall be automatically withdrawn from the Customer' s Bank Account from which the funds are withdrawn at the time of withdrawal of funds.
Article 8. Funds Transfer Fee
When the Customer requests a funds transfer at a Funds Transfer Machine, the funds transfer fee specified by the Bank and the Card Funds Transfer Partner shall be automatically withdrawn from the Customer' s Bank Account from which the funds transfer is made at the time of withdrawal of funds for transfer. The funds transfer fee charged by the Card Funds Transfer Partner shall be paid by the Bank to the Card Funds Transfer Partner.
Article 9. Loss of Card or Device
- (1) When the Customer loses a Card or Device, a Card is likely to be used by others as a result of counterfeit, forgery, theft or loss of the Card, a Device is likely to be used by others as a result of theft or loss of the Device, or it is discovered that a Card or Device is used by others, the Customer must notify the Bank immediately by the method specified by the Bank. The Bank shall suspend withdrawals from the Customer' s Bank Account and restrict other transactions at the time when the Customer notifies the Bank. The Bank shall not be responsible or liable for any damage incurred prior to the notification except in the cases specified in Articles 11 and 12. When the Customer incurs any damage as a result of loss of a Card, the Customer may be eligible to receive compensation for the damage in whole or in part in accordance with the Terms and Conditions of Compensation for Cash Card Theft.
- (2) When the Customer loses or is unable to use a Card, the Customer must always follow the replacement procedures specified by the Bank. If the Customer fails to replace such Card, the Customer' s Bank Account shall be closed.
- (3) The Customer must pay the replacement fee specified by the Bank for a replacement Card.
However, the Bank shall waive the replacement fee for a damaged Card.
In this case, the Bank may request the Customer to submit the damaged Card to the Bank for examining the damage to the Card. If the Bank cannot confirm the damage to the Card as a result of the examination, the Bank shall charge the replacement fee specified by the Bank.
Article 10. Verification of PIN
- (1) The Customer must keep a Card and Device safe so that they won' t be used by others. The Bank strongly encourages the Customer to avoid using the date of birth or telephone number, a repeated number or any other number that is easily guessed by others as a PIN, change it regularly and keep it strictly confidential to prevent disclosure to any third party.
- (2) When the Bank processes the Card and Cardless ATM used for operating a Withdrawal Machine or a Funds Transfer Machine as the Card and Cardless ATM issued or provided by the Bank based on the electromagnetic records of the Card and Cardless ATM and processes a withdrawal of funds after confirming that the PIN entered at the Withdrawal Machine or the Funds Transfer Machine is the same as that registered with the Bank by the method specified by the Bank and deeming that the PIN entered is not different from the PIN registered, the Bank, the Deposit Partner, the Withdrawal Partner or the Card Funds Transfer Partner shall not be responsible or liable for any damage caused by any accident that occurs to the Card and Cardless ATM or PIN. However, the Bank' s responsibility and liability for any damage caused by such withdrawal using a counterfeit, forged or stolen Card shall be subject to Articles 11 and 12.
Article 11. Withdrawals Using Counterfeit or Forged Card
- (1) Any withdrawal using a counterfeit or forged Card of an individual customer (including a sole proprietor customer) at a Withdrawal Machine or a Funds Transfer Machine shall be considered invalid. However, this provision shall not apply if such withdrawal is attributable to the Customer' s willful misconduct, or the Bank proves that the Bank processes the withdrawal in good faith and without negligence and that such withdrawal is attributable to the Customer' s gross negligence. When a counterfeit or forged Card is used to withdraw funds, the Customer shall submit documents specified by the Bank and cooperate with the Bank in investigating the level of management of a Card and PIN, damage incurred and whether or not such unauthorized withdrawal is reported to the police. As for damage caused by the use of a counterfeit or forged Card, the Customer may be eligible to receive compensation for the damage in whole or in part in accordance with the Terms and Conditions of Compensation for Cash Card Theft.
- (2) As for any withdrawal using a counterfeit or forged Card of a business customer (excluding a business entity registered in the commercial register in Japan and having its registered office or principal place of business outside Japan) at a Withdrawal Machine or a Funds Transfer Machine, the Bank shall not be responsible or liable for any damage incurred as a result of the withdrawal to the extent that the Bank processes such withdrawal after confirming that the PIN entered at the Withdrawal Machine or the Funds Transfer Machine is the same as that registered with the Bank by the method specified by the Bank and deeming that the PIN entered is not different from the PIN registered. However, the Customer may be eligible to receive compensation for the damage in whole or in part in accordance with the Terms and Conditions of Compensation for Cash Card Theft.
Article 12. Withdrawals Using Stolen Card
- (1) Individual customers (including sole proprietor customers) shall be entitled to request the payment of the Amount for Compensation defined in Article 12.(2) for any unauthorized withdrawal made by others using a Card stolen from the Customer at a Withdrawal Machine or a Funds Transfer Machine when:
- A) the theft of the Card is notified to the Bank promptly after it is discovered;
- B) the Customer gives the Bank sufficient explanations when the Bank conducts an investigation; and
- C) the Customer provides the Bank with evidence which suggests the occurrence of the theft such as reporting of the theft to the police.
- (2) When the request under Article 12.(1) is made by the Customer, and the withdrawal is not attributable to the Customer' s willful misconduct, the Bank shall refund an amount equal to the amount of the withdrawal (including fees, charges and interests) that occurs on or after the day thirty (30) days, (or when the Customer proves that the Customer is unable to notify the Bank due to any event that is beyond the control of the Customer, thirty (30) days plus the number of days, during which such event occurs) prior to the date of notification to the Bank (for purposes of these Terms and Conditions, "Amount Eligible for Refund"). However, when the Bank proves that the Bank processes the withdrawal in good faith and without negligence and that it is attributable to the Customer' s negligence, the Bank shall refund an amount equal to three-quarters (3/4) of the Amount Eligible for Refund. The payment of the refund shall be subject to the Terms and Conditions of Compensation for Cash Card Theft separately specified by the Bank.
- (3) When the notification to the Bank under Article 12.(1) is made after the lapse of two (2) years following the date of theft (if such date of theft is unknown, the first day on which an unauthorized withdrawal using the stolen Card and Cardless ATM at a Withdrawal Machine or a Funds Transfer Machine occurs as a result of the theft), the provisions of Articles 12.(1) and 12.(2) shall not apply.
- (4) Notwithstanding Article 12.(2), the Bank shall not be liable to compensate for any damage when the Bank proves that:
- A) the Bank processes the withdrawal in good faith and without negligence; and
- a) the withdrawal is attributable to the Customer' s gross negligence;
- b) the withdrawal is made by the Customer' s spouse, first- or second-degree relative, relative living in the same household or any other housemate or domestic worker (such as a housekeeper who provides general cleaning and other home services); or
- c) the Customer provides the Bank with false explanations for damage incurred by the Customer in important aspects; or
- B) the Customer' s Card is stolen during or as a result of substantial social unrest caused by a war, riot or any other similar event.
- A) the Bank processes the withdrawal in good faith and without negligence; and
- (5) The Bank shall not be responsible or liable for any damage caused by unauthorized withdrawals made by others using a Card stolen from a business customer (excluding a business entity registered in the commercial register in Japan and having its registered office or principal place of business outside Japan) at a Withdrawal Machine or a Funds Transfer Machine as a result of theft of the Card to the extent that the Bank processes such withdrawals after confirming that the PIN entered at the Withdrawal Machine or the Funds Transfer Machine is the same as that registered with the Bank by the method specified by the Bank and deeming that the PIN entered is not different from the PIN registered. However, the Customer may be eligible to receive compensation for the damage in whole or in part in accordance with the Terms and Conditions of Compensation for Cash Card Theft.
Article 13. Error in Information Entered at Deposit Machine, Withdrawal Machine or Funds Transfer Machine
The Bank, the Deposit Partner, the Withdrawal Partner or the Card Funds Transfer Partner shall not be responsible or liable for any damage caused by any error in the information such as an amount of funds and account number the Customer enters at a Deposit Machine, Withdrawal Machine or Funds Transfer Machine or error the Customer makes when operating such equipment.
Article 14. Closing Bank Account; Suspension of Card and Cardless ATM
- (1) When the Customer closes the Customer' s Bank Account, the Customer must return to the Bank or destroy a Card issued for such Bank Account at the Customer' s own risk. This provision shall also apply when the Customer' s Bank Account is closed in accordance with the PayPay Bank Account Terms and Conditions.
- (2) When the Bank finds any inappropriate use of the Card and Cardless ATM including falsification and unauthorized use of a Card, the Bank may prohibit the Customer from using the Card and Cardless ATM. When the Customer is prohibited from using the Card and Cardless ATM, the Customer must immediately return a Card to the Bank as required by the Bank.
- (3) The Bank may suspend the use of the Card and Cardless ATM in any of the cases listed under A) to E) of this Article 14.(3). Upon such suspension, the Customer must immediately return a Card as required by the Bank. However, in the case specified under C) of this Article 14.(3), the Bank shall terminate such suspension when the Bank confirms that it is the Customer who has used the Card and Cardless ATM by the method specified by the Bank.
- A) the Customer breaches Article 2.(2);
- B) transactions involving the Customer' s Bank Account are suspended in accordance with the PayPay Bank Account Terms and Conditions;
- C) the period separately indicated by the Bank passes following the last deposit or withdrawal transaction involving the Customer' s Bank Account;
- D) the Bank considers that the Customer' s Card is likely to be used by any unauthorized third party as a result of counterfeit, forgery, theft or loss of the Card; or
- E) the Bank considers that the Cardless ATM is likely to be used by any unauthorized third party as a result of theft or loss of the Customer' s Device.
Article 15. Application of Other Terms and Conditions
Any matter not specified in these Terms and Conditions shall be subject to the Bank' s other terms and conditions, rules and other provisions specified by the Bank. The Bank shall disclose the Bank' s other terms and conditions, rules and other provisions by posting them on the Bank' s website.
Article 16. Amendment of Terms and Conditions
- (1) The Bank shall amend any provision of these Terms and Conditions or other terms and conditions in accordance with Article 548-4 of the Civil Code of Japan when the Bank deems it reasonably necessary to respond to any change in economic or other circumstances, or for other reasons.
- (2) When the Bank amends any provision of these Terms and Conditions or other terms and conditions pursuant to Article 16.(1), the Bank shall announce the amendment as well as the details and effective date of the amened provision by publication on the internet or by other reasonable means.
- (3) The amendment under Articles 16.(1) and 16.(2) shall take effect on the effective date specified at the time of publication. The Bank shall provide a reasonable period between the date of publication and the effective date depending on the details of the amendment.
